These Terms of Service (“Terms”) will be effective from 21st May, 2026 (“Effective Date”) and were last updated on 11th May, 2026

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE ACCESSING, USING, OR PURCHASING PRODUCTS FROM THIS WEBSITE. BY ACCESSING OR USING THE PLATFORM, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS OF USE, OUR PRIVACY POLICY, SHIPPING POLICY, RETURN & REFUND POLICY, AND ANY OTHER POLICIES REFERENCED HEREIN.

1. INTRODUCTION

The website located at www.canflex.in (“Website”) and social commerce page, or digital service operated by CanFlex Clothing (“CanFlex”, “Company”, “we”, “us”, or “our”) are collectively referred to as the “Platform”.

These Terms of Use (“Terms”) govern:

  • access to the Platform,
  • purchase of products,
  • participation in loyalty or membership programs,
  • interactions with CanFlex,
  • and all services provided through the Platform (“Services”).

By accessing the Platform, creating an account, placing an order, or otherwise using any Services, you acknowledge that you have read, understood, and agreed to these Terms.

2. ABOUT CANFLEX

CanFlex is an Indian streetwear and lifestyle apparel brand engaged in the sale of oversized t-shirts, graphic apparel, limited-edition merchandise, and related fashion products.

CanFlex may operate through:

  • its own website,
  • third-party marketplaces,
  • social media platforms,
  • pop-up stores,
  • or affiliated retail channels.

3. ELIGIBILITY

By using the Platform, you represent and warrant that:

  • You are at least 18 years old or are accessing the Platform under lawful parental or guardian supervision;
  • You are competent to enter into legally binding contracts under applicable laws;
  • All information provided by you is true, complete, accurate, and current.

CanFlex reserves the right to suspend or terminate accounts found to contain false, misleading, incomplete, or fraudulent information.

4. ACCOUNT REGISTRATION & SECURITY

To access certain features of the Platform, you may be required to create a user account.

You agree to:

  • maintain confidentiality of your account credentials;
  • accept responsibility for all activities conducted through your account;
  • immediately notify CanFlex of unauthorized access or security breaches.

You shall not:

  • impersonate another individual or entity;
  • create fake or duplicate accounts;
  • use misleading identities;
  • transfer or sell your account.

CanFlex shall not be liable for losses resulting from unauthorized account usage arising from your failure to maintain account security.

CanFlex reserves the right to:

  • suspend accounts,
  • refuse service,
  • cancel orders,
  • restrict access,
  • or permanently terminate accounts

where suspicious, abusive, unlawful, or fraudulent activity is detected.

5. PRODUCTS & SERVICES

CanFlex offers apparel and lifestyle merchandise through the Platform.

All products are subject to:

  • stock availability,
  • manufacturing limitations,
  • quality inspections,
  • and operational feasibility.

CanFlex reserves the right to:

  • limit product quantities;
  • discontinue products;
  • modify pricing;
  • update specifications;
  • withdraw collections or product drops;
  • refuse bulk or reseller orders.

Adding products to cart does not reserve inventory.

Certain products may be:

  • limited edition,
  • made-to-order,
  • drop-exclusive,
  • non-restockable,
  • or available only for limited durations.

6. PRODUCT INFORMATION & DISPLAY

CanFlex strives to ensure accurate product descriptions, images, colors, pricing, and specifications.

However:

  • actual colors may vary due to screen settings and lighting;
  • product sizing may involve minor manufacturing variations;
  • graphics placement may slightly differ from displayed images.

The Platform may occasionally contain:

  • typographical errors,
  • pricing inaccuracies,
  • outdated information,
  • or technical mistakes.

CanFlex reserves the right to correct such errors without prior notice, including after an order is placed.

7. PRICING & PAYMENTS

All prices displayed on the Platform are in Indian Rupees (INR).

Applicable taxes, shipping charges, convenience fees, or COD charges may be added at checkout.

Accepted payment methods may include:

  • UPI,
  • Debit/Credit Cards,
  • Net Banking,
  • Wallets,
  • EMI,
  • Cash on Delivery (“COD”).

CanFlex reserves the right to:

  • refuse COD eligibility;
  • impose prepaid-only restrictions;
  • cancel suspicious transactions;
  • restrict payment methods;
  • conduct fraud verification checks.

In case of incorrect pricing due to technical or human error, CanFlex may cancel affected orders and issue appropriate refunds.

8. ORDER ACCEPTANCE & CANCELLATION

Order confirmation does not constitute final acceptance.

Orders are accepted only after:

  • successful payment authorization;
  • inventory confirmation;
  • internal fraud screening;
  • dispatch confirmation.

CanFlex reserves the right to cancel orders due to:

  • stock unavailability;
  • pricing errors;
  • payment failures;
  • suspicious activity;
  • logistics limitations;
  • excessive return history;
  • misuse of promotional campaigns.

Refunds for prepaid canceled orders shall be processed to the original payment method within a reasonable period.

9. SHIPPING & DELIVERY

Estimated delivery timelines are indicative and not guaranteed.

Delivery delays may occur due to:

  • courier disruptions,
  • weather conditions,
  • public holidays,
  • regional restrictions,
  • force majeure events,
  • operational constraints.

Customers are responsible for providing accurate shipping information.

CanFlex shall not be liable for:

  • incorrect addresses,
  • failed delivery attempts,
  • delays caused by courier partners,
  • orders marked delivered by logistics providers.

Risk and ownership of products pass to the customer upon successful delivery.

10. RETURNS, EXCHANGES & REFUNDS

Returns and exchanges shall be governed by the CanFlex Return & Refund Policy available on the Platform.

Products eligible for return/exchange must:

  • be unused,
  • unwashed,
  • undamaged,
  • and returned with original tags and packaging.

CanFlex reserves the right to reject returns that:

  • fail quality inspection;
  • show signs of use;
  • are returned outside prescribed timelines;
  • involve fraudulent claims;
  • involve missing packaging/components.

Certain categories including:

  • limited drops,
  • sale items,
  • customized products,
  • mystery products,
  • and promotional products

may be non-returnable or exchange-only.

CanFlex may:

  • limit return eligibility,
  • disable COD,
  • impose handling charges,
  • or suspend accounts

for users exhibiting excessive returns, refund abuse, or fraudulent activity.

11. MEMBERSHIP, REWARDS & STORE CREDITS

CanFlex may offer:

  • memberships,
  • loyalty programs,
  • reward points,
  • referral benefits,
  • store credits,
  • wallet balances,
  • or promotional incentives.

Unless otherwise specified:

  • such benefits are non-transferable;
  • cannot be redeemed for cash;
  • may carry expiry dates;
  • may be withdrawn, modified, suspended, or canceled at any time.

CanFlex reserves the right to reverse or cancel rewards obtained through:

  • misuse,
  • fraudulent activity,
  • duplicate accounts,
  • payment disputes,
  • chargebacks,
  • or policy violations.

12. USER CONTENT & SOCIAL MEDIA

If you:

  • tag CanFlex,
  • upload reviews,
  • post images/videos,
  • submit testimonials,
  • or otherwise share content featuring CanFlex products,

you grant CanFlex a worldwide, royalty-free, non-exclusive, sub-licensable license to use, reproduce, publish, display, modify, and distribute such content for marketing, advertising, promotional, or commercial purposes.

You represent that:

  • you own or control rights to such content;
  • the content does not infringe third-party rights;
  • the content is not unlawful, abusive, defamatory, obscene, misleading, or infringing.

CanFlex reserves the right to remove or refuse any user-generated content at its sole discretion.

13. PROHIBITED ACTIVITIES

You agree not to:

  • violate applicable laws;
  • interfere with Platform security;
  • scrape or copy Platform data;
  • use bots or automated systems;
  • upload malware or harmful code;
  • exploit pricing or technical loopholes;
  • misuse coupons, referrals, rewards, or discounts;
  • harass employees, partners, or customers;
  • create fake reviews or fraudulent transactions;
  • engage in resale without authorization.

Violation may result in:

  • account suspension,
  • order cancellation,
  • legal action,
  • or permanent access restriction.

14. INTELLECTUAL PROPERTY RIGHTS

All Platform content including:

  • trademarks,
  • logos,
  • graphics,
  • product artwork,
  • illustrations,
  • designs,
  • videos,
  • text,
  • branding,
  • website layouts,
  • photographs,
  • and software

are owned by or licensed to CanFlex and protected under applicable intellectual property laws.

No content may be:

  • copied,
  • reproduced,
  • modified,
  • distributed,
  • republished,
  • commercially exploited,

without prior written permission.

Unauthorized use may result in civil and criminal liability.

15. COPYRIGHT & CONTENT POLICY

Users shall not upload, post, distribute, or transmit content that:

  • infringes intellectual property rights;
  • is defamatory, obscene, hateful, misleading, violent, unlawful, discriminatory, or harmful;
  • promotes illegal activity;
  • contains malware or malicious software;
  • impersonates another person or entity;
  • violates public morality or applicable Indian laws.

CanFlex reserves the right to:

  • remove objectionable content;
  • restrict access;
  • cooperate with law enforcement authorities;
  • disclose information where legally required.

Users remain solely responsible for all content submitted by them.

16. THIRD-PARTY SERVICES

The Platform may contain links or integrations with:

  • payment gateways,
  • logistics providers,
  • social media platforms,
  • external websites,
  • third-party tools.

CanFlex does not control and shall not be responsible for:

  • third-party content,
  • policies,
  • security,
  • availability,
  • or practices.

Use of third-party services shall be at your own risk.

17. DISCLAIMER OF WARRANTIES

The Platform, products, and Services are provided on an “as is” and “as available” basis.

CanFlex makes no warranties regarding:

  • uninterrupted access;
  • website accuracy;
  • product availability;
  • error-free operation;
  • compatibility with devices;
  • or completeness of content.

To the fullest extent permitted by law, all express and implied warranties are disclaimed.

18. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, CanFlex shall not be liable for:

  • indirect damages,
  • incidental losses,
  • loss of profits,
  • business interruption,
  • emotional distress,
  • data loss,
  • consequential damages,

arising from use of the Platform or Services.

CanFlex’s total aggregate liability shall not exceed the amount paid by the customer for the relevant order giving rise to the claim.

No claim arising out of these Terms may be brought after one (1) year from the date the cause of action arose.

19. INDEMNIFICATION

You agree to indemnify and hold harmless CanFlex, its founders, affiliates, directors, employees, representatives, and partners against all losses, claims, liabilities, damages, expenses, or legal costs arising from:

  • your breach of these Terms;
  • misuse of the Platform;
  • fraudulent activity;
  • violation of laws;
  • infringement of third-party rights.

20. FORCE MAJEURE

CanFlex shall not be liable for delays or failures caused by events beyond reasonable control including:

  • natural disasters,
  • floods,
  • pandemics,
  • internet failures,
  • labor strikes,
  • cyber attacks,
  • government restrictions,
  • supply chain disruptions,
  • acts of war,
  • or transportation failures.

21. TERMINATION

CanFlex reserves the right to:

  • suspend accounts,
  • restrict access,
  • cancel orders,
  • terminate Services

without prior notice where users violate these Terms or applicable laws.

Clauses relating to:

  • intellectual property,
  • indemnification,
  • limitation of liability,
  • dispute resolution,
  • and governing law

shall survive termination.

22. SEVERABILITY

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain valid and enforceable.

23. WAIVER

Failure by CanFlex to enforce any provision shall not constitute a waiver of rights.

Any waiver shall be effective only if made in writing.

24. ASSIGNMENT

CanFlex may assign or transfer its rights and obligations under these Terms without notice.

Users may not assign or transfer their rights without prior written consent from CanFlex.

25. GOVERNING LAW & JURISDICTION

These Terms shall be governed by the laws of India.

All disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of courts located at Mumbai, Maharashtra.

26. CHANGES TO TERMS

CanFlex reserves the right to modify these Terms at any time.

Updated Terms become effective immediately upon publication on the Platform.

Continued use of the Platform constitutes acceptance of revised Terms.
